This distance service agreement describes the parties and the product's current operation for a booking created through the Platform.

1. Parties and the Platform's intermediary role

PLATFORM OPERATOR AND INTERMEDIARY SERVICE PROVIDER: ALBAYCAN GRUP TURİZM SEYAHAT VE TEKNOLOJİ SANAYİ TİCARET LİMİTED ŞİRKETİ, Hobyar Mah. Cağaloğlu Yokuşu Sk. Evren Han No: 17/210 Fatih / İstanbul, Türkiye, MERSİS 0049105288400001, TÜRSAB licence no 18704, tax office and number Hocapaşa Tax Office / 0491052884. PROVIDER SELLING AND ACTUALLY DELIVERING THE SERVICE: the business named on your booking page. BUYER: the consumer who declares their details on the booking form. The Platform is not the seller or performer of the service; it acts as an intermediary forwarding the booking request to the Provider.

2. Subject of the agreement

The subject of this agreement is the tour, boat trip, activity or transfer service whose characteristics (name, date, time, duration, number of participants, meeting point, inclusions and exclusions) are stated on the booking page. The information shown in the booking summary forms an integral part of this agreement.

3. Price and payment

The service fee is displayed in the currency shown in your booking summary. Payment is made by card through the Platform, via the Platform's authorised payment institution using 3D Secure; the Platform offers no other payment method. If the tour price is shown in a currency other than Turkish lira, your card is charged in Turkish lira (₺) and the amount charged is calculated using the exchange rate at the time of payment; the rate used and the amount charged are recorded in your booking. Card details are transmitted over an encrypted connection through the Platform to the authorised payment institution in order to initiate the payment, and are not stored by the Platform; only the masked last four digits of the card are kept in the booking record. The Platform does not collect IBAN details. Card verification (3D Secure) takes place on your own bank's page. A booking record alone is not proof of payment; the payment status is shown separately on the relevant page.

4. Performance and delivery

The service is performed by the Provider on the date and at the time stated in the booking, at the stated meeting point. If the participant is not present at the meeting point on time, the service may be deemed performed and no refund may be due.

5. Right of withdrawal and its exception

Whether a right of withdrawal applies to tours, boat trips, activities, transfers or similar services to be performed on a specific date or period depends on the nature of the service and applicable law. Where the Provider has published cancellation terms for the service, they are shown before booking. This agreement alone does not create a definitive right-of-withdrawal or exception outcome for every service.

6. Cancellation and any refund terms

Cancellation and any refund are assessed under the Provider's published terms for the booked service and applicable law. Because the fee is collected by card through the Platform, the refund is issued by the Platform through the payment institution to the card used for payment; the Platform does not promise processing times on behalf of a bank or payment institution.

7. Force majeure and Provider actions

The Provider may cancel or postpone the service in circumstances beyond the parties' control, such as adverse weather, natural disaster, decisions of public authorities, strikes or epidemics. Any alternative date, cancellation and refund assessment is made by the relevant Provider under its published terms and applicable law; the Platform does not carry out those transactions.

8. Dispute resolution

For disputes arising from this agreement, the Consumer Arbitration Committees at the consumer's place of residence or where the transaction took place are competent within the monetary limits announced each year by the Ministry of Trade; disputes above those limits fall to the Consumer Courts.
